1. قبول الشروط

من خلال الوصول إلى تطبيق Smart Palm ("التطبيق") أو استخدامه، فإنك توافق على الالتزام بشروط الاستخدام هذه. إذا كنت لا توافق على أي جزء من هذه الشروط، فلا يجوز لك استخدام التطبيق.

2. وصف الخدمة

Smart Palm هي منصة زراعة دقيقة مصممة لإدارة مزارع النخيل في الإمارات العربية المتحدة. يوفر التطبيق أدوات لإدارة المزارع وتتبع صحة الأشجار وتسجيل الإنتاج ورسم الخرائط الجغرافية وإدارة المهام والتعاون الجماعي مع أدوار المشرف والعامل، وتنبيهات المواسم، والإدارة المالية (المصاريف والأصول والمصاريف المتكررة وحساب الاستهلاك)، وتتبع الرواتب، والتحليلات.

3. خطط الاشتراك والفوترة

يقدم التطبيق مستويات اشتراك متعددة:

• الخطة المجانية: مزرعة واحدة، حتى 50 نخلة، بلا خريطة، بلا تشخيص ذكي، وبلا إدارة فريق.
• الخطة المميزة: مزارع ونخيل بلا حدود، التشخيص الذكي للأمراض، الخريطة والتحليلات، إدارة الفريق، ومنظومة الإدارة المالية الكاملة.
• الفترة التجريبية: يحصل المستخدمون الجدد على فترة تجريبية مجانية لمدة 7 أيام بجميع ميزات الخطة المميزة.

يتم الفوترة سنوياً عبر متجر Google Play أو Apple App Store. الأسعار معروضة بالدرهم الإماراتي وقد تختلف حسب المنطقة. يتم تجديد الاشتراكات تلقائياً ما لم يتم إلغاؤها قبل 24 ساعة على الأقل من نهاية فترة الفوترة الحالية. يمكنك إدارة أو إلغاء اشتراكك من إعدادات المتجر. تخضع المبالغ المستردة لسياسات المتجر.

4. تشخيص الأمراض بالذكاء الاصطناعي

يقدم التطبيق ميزة تشخيص أمراض النخيل بالذكاء الاصطناعي باستخدام تحليل الصور (متاحة لمشتركي الخطة المميزة والفترة التجريبية فقط). يتم معالجة الصور بشكل آمن عبر بنيتنا التحتية على السيرفر (Supabase Edge Function) قبل إرسالها إلى Gemini AI من Google للتحليل — لا يتم كشف أي مفاتيح API للذكاء الاصطناعي على جهاز المستخدم.

هذه الميزة مقدمة لأغراض المعلومات والتوجيه فقط ولا تشكل استشارة زراعية أو نباتية متخصصة. يجب على المستخدمين دائماً استشارة متخصصين زراعيين مؤهلين قبل اتخاذ قرارات العلاج. قد تختلف دقة التشخيص بالذكاء الاصطناعي حسب جودة الصورة وظروف الإضاءة وطبيعة المرض. لا تتحمل SmartLoop Technology، المشغّل لتطبيق Smart Palm، أي مسؤولية عن خسائر المحاصيل الناتجة عن الاعتماد على التشخيصات المولدة بالذكاء الاصطناعي.

يقدّم التطبيق أيضاً مساعداً ذكياً للمزرعة (للخطة المميزة والفترة التجريبية، لمالك المزرعة فقط). يجيب المساعد من السجلات التي أدخلتها في التطبيق وحدها، وقد يخطئ في قراءتها أو عرضها؛ فتحقّق من أي رقم يذكره على شاشات التطبيق نفسها. ولا يستطيع المساعد تغيير بياناتك: أي إجراء يقترحه يفتح شاشة تراجعها وتحفظها بنفسك، وأنت المسؤول عمّا تحفظه. ولا تتحمّل SmartLoop Technology مسؤولية قرارات تُتخذ اعتماداً على إجابات المساعد.

5. تذكيرات الخطة والإشعارات

يذكّر التطبيق المستخدم بالخطة السنوية التي يكتبها بنفسه في التقويم الزراعي؛ ولم يعد هناك اعتماد على تقويم زراعي إماراتي ثابت. وكل بند في الخطة إمّا مهمة تُسند إلى عامل، أو تذكير ينبّه المالك وحده.

تُعرض خطة ابتدائية عند أول استخدام، وللمستخدم أن يعدّلها أو يحذفها بالكامل. تصل التذكيرات داخل التطبيق وعبر الإشعارات الفورية (Push)، وهي إرشادية فقط ولا تحل محل الإرشاد الزراعي المتخصص.

6. إدارة الفريق

يستطيع مشتركو الخطة المميزة والفترة التجريبية بناء فريق للتعاون في إدارة المزرعة. يتضمن النظام:

• دور المشرف: يشرف على العمال، يمكن ربطه بعدة عمال، ويمكن تكليفه بمزرعة أو عدة مزارع.
• دور العامل: يستلم المهام، يمكن تكليفه بمزرعة أو عدة مزارع.
• أكواد الدعوة: يُنشئها مالك المزرعة، صالحة لمدة 7 أيام، يدخلها العضو الجديد عند التسجيل.
• تكليف متعدد المزارع: يمكن تعيين المشرف الواحد أو العامل الواحد على عدة مزارع في نفس الوقت.
• أرشفة العامل (الاستقالة): يمكن لمالك المزرعة أرشفة العامل (اعتباره مستقيلاً) في أي وقت. لا يظهر العامل المؤرشف في قائمة الفريق النشطة ولا يستطيع الوصول إلى بيانات المزرعة، لكن سجلات رواتبه وقيوده في الإدارة المالية تبقى محفوظة بالكامل. يستطيع المالك إعادة تفعيل العامل المؤرشف لاحقاً.

يمكن لأعضاء الفريق الوصول فقط إلى بيانات المزارع المخصصة لهم. يتحمل صاحب المزرعة مسؤولية إدارة وصول أعضاء الفريق وصلاحياتهم.

7. منظومة الإدارة المالية

يحصل مشتركو الخطة المميزة والفترة التجريبية على وصول لمنظومة الإدارة المالية التي تتضمن:

• تتبع المصاريف: تسجيل المصاريف ضمن فئات متعددة (ماء، كهرباء، أسمدة، مبيدات، وقود، رواتب، إلخ). يمكن إنشاء فئات مخصصة.
• تتبع الأصول: تسجيل الأصول الثابتة (المعدات، المركبات، أنظمة الري) مع قيمة الشراء وتاريخ الشراء والعمر المتوقع. يُطبّق النظام تلقائياً الاستهلاك بالطريقة الخطية.
• النخيل كأصل: يحسب النظام تلقائياً صفاً للأصل لكل مزرعة يمثّل عدد النخيل الحية (بسعر مقطوع 500 درهم لكل نخلة). هذا الصف يديره النظام ولا يمكن تعديله أو حذفه.
• المصاريف المتكررة: تعريف قوالب (شهري، ربع سنوي، سنوي). النظام يُنشئ المصروف تلقائياً عند حلول موعد الاستحقاق.
• صور الإيصالات: إرفاق صورة مع أي مصروف. تُخزَّن الإيصالات في حاوية خاصة (Bucket) لا يمكن الوصول إليها إلا عبر روابط موقّعة قصيرة الصلاحية.
• عرض متعدد المزارع: مصاريف وأصول جميع مزارع المالك مجمّعة في صفحة واحدة، مع إمكانية الاستعراض لكل مزرعة على حدة.
• تكامل الرواتب: تسجيل دفعة راتب أو سلفة لعامل في إدارة الفريق يُنشئ تلقائياً قيد مصروف مقابل في الإدارة المالية تحت فئة الرواتب، مُخصَّصاً للمزرعة المرتبطة بالعامل. حذف أي قيد من الجانبين يحذف القيد المقابل في الآخر (مزامنة ثنائية الاتجاه). دفع السلفة (الاسترداد) لا يُسجَّل كمصروف.

جميع التقييمات المالية وحسابات الاستهلاك تقديرات مبنية على البيانات التي يدخلها المستخدم. لا يضمن التطبيق دقة أي رقم مالي، ولا ينبغي استخدام هذه الأرقام بديلاً عن السجلات المحاسبية الرسمية.

8. البيانات المالية والتقييمات

جميع التقييمات المالية وتوزيعات الإنتاج وحسابات الاستهلاك والقيم المقدرة المعروضة في التطبيق (بالدرهم الإماراتي أو أي عملة أخرى) هي تقديرات فقط (متاحة لمشتركي الخطة المميزة والفترة التجريبية). تستند هذه الحسابات إلى بيانات يقدمها المستخدم أو جداول أسعار مرجعية أو أسعار احتياطية عند عدم توفر أسعار محددة. لا يضمن التطبيق دقة أي رقم مالي. يجب ألا يعتمد المستخدمون حصرياً على هذه التقديرات في القرارات التجارية أو الضريبية أو الاستثمارية.

9. حسابات المستخدمين والبيانات

أنت مسؤول عن الحفاظ على سرية بيانات حسابك. يتم تخزين جميع البيانات التي تدخلها في التطبيق (مواقع المزارع، سجلات الأشجار، بيانات الإنتاج، تفاصيل المهام، السجلات المالية، صور الإيصالات، وسجلات الرواتب) بشكل آمن في البنية التحتية السحابية. أنت تحتفظ بملكية بياناتك في جميع الأوقات.

10. الاستخدام المقبول

توافق على استخدام التطبيق فقط لأغراض مشروعة تتعلق بالإدارة الزراعية. لا يجوز لك محاولة الهندسة العكسية أو تعديل أو تعطيل وظائف التطبيق. يُحظر تماماً الوصول غير المصرح به إلى بيانات المستخدمين الآخرين.

11. توفر الخدمة

نسعى للحفاظ على توفر التطبيق بشكل مستمر، لكننا لا نضمن الوصول دون انقطاع. قد تكون الخدمة غير متاحة مؤقتاً بسبب الصيانة أو التحديثات أو عوامل خارجة عن سيطرتنا. يعتمد تسليم الإشعارات الفورية على اتصال الشبكة وقد يتأخر في المناطق ذات الاتصال المحدود بالإنترنت.

12. تحديد المسؤولية

يتم تقديم Smart Palm "كما هو" دون ضمانات من أي نوع. إلى أقصى حد يسمح به القانون، لن تكون SmartLoop Technology مسؤولة عن أي أضرار غير مباشرة أو عرضية أو تبعية ناشئة عن استخدام التطبيق، بما في ذلك على سبيل المثال لا الحصر خسائر المحاصيل أو القرارات المالية أو نزاعات الرواتب أو أخطاء التقارير الضريبية أو تفويت التنبيهات الموسمية أو فقدان البيانات.

13. التعرّف على صنف التمر

• ميزة متاحة لكل المستخدمين بما فيهم الخطة المجانية، وموسومة تجريبياً.
• التعرّف آلي وقد يكون خاطئاً: النتيجة اقتراح، لا شهادة صنف، ولا أساس لبيع أو سعر أو تعاقد.
• بخلاف تشخيص الأمراض، تُخزَّن الصورة وقد يراجعها شخص من الفريق — راجع البند 4 من سياسة الخصوصية.
• أرسل صور التمر وحدها: لا أشخاص ولا وثائق هوية ولا أي شيء سرّي.
• لا تتحمّل SmartLoop أي مسؤولية عن قرار تجاري بُني على نتيجة تعرّف.

14. المحتوى الذي ترسله

• تبقى ملكية المحتوى للمستخدم.
• تمنح SmartLoop Technology ترخيصاً غير حصري وبلا مقابل لتخزين هذا المحتوى واستخدامه في تشغيل ميزة التعرّف وتحسينها وتحسين قائمة الأصناف.
• تؤكّد أن للمحتوى حقّ إرساله وأنه لا ينتهك حقوق أحد.
• المساهمة اختيارية، ويبيّن التطبيق متى يُستخدم المحتوى كمساهمة.
• لك حق طلب الحذف في أي وقت عبر support@smartloop.tech، والحذف يتم مع حذف الحساب. أما تحسين دخل قائمة الأصناف فلا يُتتبَّع ولا يُلغى.
• يجوز لنا رفض أو إزالة أي مشاركة غير متصلة بالموضوع أو غير صالحة أو تحتوي مادة خاصة.

15. بيانات الأشخاص الآخرين

• يتيح التطبيق لمالك الحساب تسجيل بيانات عن عمّاله: أسماء، وثائق هوية أو إقامة وتواريخ انتهائها، إجازات، رواتب، وبيانات دخول.
• هذه بيانات عن أشخاص آخرين يُدخلها المالك، وهو المسؤول عن حقّه في الاحتفاظ بها وعن إبلاغ أصحابها بأنها محفوظة في التطبيق.
• لا يجوز رفع وثيقة تخصّ شخصاً لم يوافق.
• تخزّن SmartLoop هذه البيانات وتعالجها بالنيابة عن المالك لتشغيل الميزات التي يستخدمها، ولا تستخدمها لأي غرض خاص بها.
• أرشفة العامل تحفظ سجله، وحذف الحساب يحذفه.
• كلمات مرور العمّال مُعمّاة (hashed)، وعلى المالك حفظ سريتها وتسليمها لصاحبها وحده.

16. تغييرات الشروط

نحتفظ بالحق في تعديل هذه الشروط في أي وقت. يشكل الاستمرار في استخدام التطبيق بعد التغييرات قبولاً للشروط المعدلة. سيتم إخطار المستخدمين بالتغييرات الجوهرية من خلال التطبيق.

17. القانون الحاكم

تخضع هذه الشروط وتُفسر وفقاً لقوانين دولة الإمارات العربية المتحدة.

1. Acceptance of Terms

By accessing or using Smart Palm ("the App"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the App.

2. Description of Service

Smart Palm is a precision agriculture platform designed for managing palm tree farms in the UAE. The App provides tools for farm management, tree health tracking, production recording, GIS mapping, task management, team collaboration with supervisor/worker roles, seasonal event alerts, financial management (expenses, assets, recurring expenses, depreciation tracking), salary tracking, and analytics.

3. Subscription Plans & Billing

The App offers multiple subscription tiers:

• Free Plan: 1 farm, up to 50 palm trees, no map, no AI diagnosis, and no team management.
• Premium Plan: Unlimited farms and palms, AI-powered disease diagnosis, map and analytics, team management, and the full Financial Management module.
• Free Trial: New users receive a 7-day free trial with full Premium features.

Subscriptions are billed annually through the Google Play Store or Apple App Store. Pricing is displayed in AED and may vary by region. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through the store settings. Refunds are subject to store policies.

4. AI-Powered Disease Diagnosis

The App offers an AI-powered palm disease diagnosis feature using image analysis (Premium and Trial users only). Images are processed securely through our server-side infrastructure (Supabase Edge Function) before being sent to Google's Gemini AI for analysis — no AI API keys are exposed on the client device.

This feature is provided for informational and guidance purposes only. It does not constitute professional agricultural, botanical, or phytopathological advice. Users should always consult qualified agricultural professionals before making treatment decisions. Accuracy may vary depending on image quality, lighting conditions, and disease presentation. SmartLoop Technology, the operator of Smart Palm, is not liable for any crop loss or damage resulting from reliance on AI-generated diagnoses.

The App also offers an AI farm assistant (Premium and Trial, farm owner only). It answers only from the records you have entered in the App and may still misread or misstate them; check every figure it gives against the App's own screens. The assistant cannot change your data: any action it proposes opens a screen that you review and save yourself, and you are responsible for what you save. SmartLoop Technology is not liable for decisions taken in reliance on the assistant's answers.

5. Plan Reminders & Notifications

The App reminds the user of the annual plan they write themselves in the Agricultural Calendar; there is no longer any reliance on a fixed UAE agricultural calendar. Each item in the plan is either a task assigned to a worker or a reminder for the owner alone.

An initial plan is shown on first use, and the user may change it or delete it entirely. Reminders are delivered in the App and via push notifications; they are informational only and do not replace professional agricultural guidance.

6. Team Management

Premium and Trial users can build a team to collaborate on farm management. The team system includes:

• Supervisor role: Oversees workers, can be linked to multiple workers, and can be assigned to one or more farms.
• Worker role: Receives task assignments. Can be assigned to one or more farms.
• Invite codes: Generated by the farm owner, valid for 7 days, must be entered by the team member during signup.
• Multi-farm assignment: A single supervisor or worker can be assigned to multiple farms simultaneously.
• Worker archive (resignation): The farm owner can archive a worker (mark as resigned) at any time. Archived workers no longer appear in the active team list and lose access to farm data, but their salary records and Financial Management entries are preserved. Archived workers can be reactivated by the owner.

Team members can only access data for the farms they are assigned to. The farm owner is responsible for managing team member access and permissions.

7. Financial Management Module

Premium and Trial users have access to a Financial Management module that includes:

• Expense tracking: Record expenses across categories (water, electricity, fertilizers, pesticides, fuel, salaries, etc.). Custom categories can be created.
• Asset tracking: Record fixed assets (equipment, vehicles, irrigation systems) with purchase value, purchase date, and expected lifespan. The system applies straight-line depreciation automatically.
• Palms as asset: The system auto-computes a synthetic asset row per farm representing the live palm count (at a flat AED 500 per palm). This row is managed by the system and cannot be edited or deleted.
• Recurring expenses: Define templates (monthly, quarterly, annually). The system auto-generates the expense on the due date.
• Receipt photos: Attach an image to any expense. Receipts are stored in a private bucket, accessible only via short-lived signed URLs.
• Multi-farm view: Expenses and assets across all owner farms are aggregated in one view, with per-farm drilldown.
• Salary integration: Recording a worker's salary payment or advance in Team Management automatically creates a corresponding expense entry in Financial Management under the Salaries category, attributed to the worker's assigned farm. Deleting either entry deletes the linked one (bidirectional sync). Advance repayments are NOT recorded as expenses.

All financial valuations and depreciation calculations are estimates based on user-provided data. The App does not guarantee the accuracy of any financial figure and these figures should not be used as a substitute for official accounting records.

8. Financial Data & Valuations

All financial valuations, yield distributions, depreciation calculations, and estimated values displayed in the App (in AED or any other currency) are estimates only (Premium and Trial users). These calculations are based on user-provided data, reference pricing tables, or fallback rates when specific pricing is unavailable. The App does not guarantee the accuracy of any financial figure. Users should not rely solely on these estimates for commercial, tax, or investment decisions.

9. User Accounts & Data

You are responsible for maintaining the confidentiality of your account credentials. All data you enter into the App (farm locations, tree records, production data, task details, financial records, receipt photos, and salary records) is stored securely in cloud infrastructure provided by Supabase. You retain ownership of your data at all times.

10. Acceptable Use

You agree to use the App only for lawful purposes related to agricultural management. You may not attempt to reverse engineer, modify, or disrupt the App's functionality. Unauthorized access to other users' data is strictly prohibited.

11. Service Availability

We strive to maintain continuous availability of the App, but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. Real-time notification delivery depends on network connectivity and may experience delays in areas with limited internet access.

12. Limitation of Liability

Smart Palm is provided "as is" without warranties of any kind. To the maximum extent permitted by law, SmartLoop Technology shall not be liable for any indirect, incidental, or consequential damages arising from the use of the App, including but not limited to crop losses, financial decisions, payroll disputes, tax-reporting errors, missed seasonal alerts, or data loss.

13. Date Variety Recognition

• Available to all users, including the Free plan, and labeled as experimental.
• Recognition is automated and may be wrong: the result is a suggestion, not a variety certificate, and no basis for a sale, price, or contract.
• Unlike disease diagnosis, the image is stored and may be reviewed by a member of the team — see Section 4 of the Privacy Policy.
• Send photos of the date alone: no people, no ID documents, nothing confidential.
• SmartLoop bears no liability for a commercial decision based on a recognition result.

14. Content You Submit

• Ownership of the content remains with the user.
• You grant SmartLoop Technology a non-exclusive, royalty-free license to store this content and use it to operate and improve the recognition feature and to improve the variety list.
• You confirm that you have the right to submit the content and that it does not infringe anyone's rights.
• Contributing is optional, and the App indicates when content is used as a contribution.
• You have the right to request deletion at any time via support@smartloop.tech, and deletion occurs with account deletion. An improvement already incorporated into the variety list, however, is not traced and is not reversed.
• We may reject or remove any submission that is off-topic, invalid, or contains private material.

15. Other People's Data

• The App lets the account owner record data about their workers: names, ID or residency documents and their expiry dates, leaves, salaries, and login credentials.
• This is data about other people, entered by the owner, who is responsible for their right to keep it and for informing those individuals that it is stored in the App.
• You may not upload a document belonging to a person who has not consented.
• SmartLoop stores and processes this data on the owner's behalf to operate the features they use, and does not use it for any purpose of its own.
• Archiving a worker preserves their record, and deleting the account deletes it.
• Worker passwords are hashed; the owner must keep them confidential and hand them only to their rightful holder.

16. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the App after changes constitutes acceptance of the revised terms. Users will be notified of significant changes through the App.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.
